What §2257 covers

18 U.S.C. §2257 and 28 C.F.R. Part 75 require operators of websites that produce or distribute visual depictions of actual sexually explicit conduct by actual human beings to keep age-verification records for every performer and to identify a custodian of those records.

How stipplehub produces images

Every image generated through stipplehub is produced on-demand by AI image-generation models running on third- party GPU infrastructure. The output is an entirely synthetic illustration of fictional, drawn characters. No frame of any output corresponds to an actual person, no part of any output is a photograph or videograph of a real human being, and no actual sexually explicit conduct by an actual human being is depicted in any output.

stipplehub does not host, distribute, or produce photographic or videographic content of real persons. We do not employ performers. There is no production of "actual sexually explicit conduct" within the meaning of §2257.

Reference images

When users upload a reference image for image-to-image generation, that reference image is used transiently as an input to the generation model and is not redistributed, republished, or stored beyond what is necessary to perform the requested generation. Users who upload reference images are required, under our Terms of Service, to have all necessary rights to do so and to comply with our Content Policy, which prohibits non-consensual imagery and content depicting real, identifiable people in sexual contexts.

Conclusion

Because stipplehub does not produce, distribute, or host visual depictions of actual sexually explicit conduct by actual human beings, the record-keeping requirements of 18 U.S.C. §2257 and 28 C.F.R. Part 75 do not apply.

If our production model changes in a way that brings §2257 into scope, we will update this statement and designate a custodian of records before any such content is made available.
